Why 7-Eleven is suing Nike over shoes

The color scheme and release date of the new Nike Air Max 95 Big Bubble Sport Green and Safety Orange are the subject of a trademark infringement lawsuit 7-Eleven brought against the sneaker supplier last week
The suit allegesNike is piggybacking off the convenience chain’s brand by using the orange, green and red stripe pattern, or Tri-Color Mark, that already appears on 7-Eleven storefronts and apparel
“Indeed, there is already consumer confusion as to an affiliation between the (Nike Air Max 95 Big Bubble Sport Green and Safety Orange) and 7-Eleven,” the suit reads. “Product listings of the (Nike Air Max 95 Big Bubble Sport Green and Safety Orange) call the product the ‘7-Eleven’ shoe.”
7-Eleven cited actual collaborations it did with other footwear and athletic brands such as Crocs and DGK, while claiming Nike was attempting to “knowingly, willfully, intentionally, and maliciously” trick consumers into believing these sneakers were officially associated with 7-Eleven
The brands were actually set to work together back in 2020 on the 7-Eleven x Nike SB Dunk Low for the 2020 Olympics in Tokyo, but the COVID-19 pandemic shelved those plans. But 7-Eleven’s repeated attempts to solve this situation without a lawsuit ended with Nike saying it was still going forward with the launch of the sneakers, according to the suit
As for the July 11 release date, that is already 7-Eleven’s “Free Slurpee Day.” And as of now, the shoes are no longer listed on Nike’s website for release, but there are still sellerslisting the shoeson secondary websites
7-Eleven is now looking for these new Air Maxes to be destroyed and to get any profits Nike might have made from them, along with legal fees
Both companies have dealt with their fair share of turmoil already this year, with Nike laying off 1,400 employees and 7-Eleven closing more than 600 stores
